TERMS

Terms & Disclaimer

Last updated: October 14, 2026

These terms govern your use of vaping.dev. Please read them. They limit what this research site is, who may use it, and what you can hold us responsible for. If you do not agree, do not use the site and do not join the waitlist.

1. Research concept only

vaping.dev is a non-commercial research and design concept published by California Chicken Co., a Delaware corporation. The site describes an idea: a programmable 510-thread battery that would unlock only during a software agent session. That idea is a sketch. It is not a product you can buy.

No product exists. Nothing on this site is an offer to sell, a solicitation, or an invitation to make an offer. We do not accept orders, preorders, reservations, deposits, or payments of any kind. There is no checkout, no cart, and no way to pay us through this site.

If a form asks what you would pay, that question only gauges interest. Your answer does not create an offer, a contract, a reservation, a price quote, or any right to receive hardware, firmware, software, or a future product. We do not promise to build anything, to contact you, or to honor any price you select.

The site is not commercial and is not operated for profit. References to prices, carts, batteries, or sessions are hypothetical. They describe a concept under discussion, not goods in commerce.

2. No affiliation or endorsement

vaping.dev is not affiliated with, endorsed by, or sponsored by Anthropic, PBC, Claude, Claude Code, or any vape, nicotine, cannabis, or cartridge brand. Mentioning those names explains the concept. It does not mean those companies made, approved, or are involved with this site.

Claude, Claude Code, Anthropic, and all other product and company names are trademarks of their owners. We use them only to identify the tools and categories the concept refers to. No trademark owner has licensed this site.

“510-thread” and “510” describe a common, generic cartridge interface used across the industry. The term is not a claim that we make cartridges, that any brand’s cartridge is approved for this concept, or that a particular brand is a partner.

3. Age restriction

This site is for adults 21 and older. If you are under 21, you may not use the site, submit the waitlist form, or send us information. By using the site or joining the waitlist, you state that you are 21 or older.

We do not want data from anyone under 21. If we learn that a submission came from someone under 21, we will delete the email and the answers that came with it. To report an underage submission, email michael@hellyeahai.com with the address to remove.

Parents and guardians should not allow minors to use this site. The concept discusses nicotine and vaping. It is not directed at children.

4. Health warnings

Nicotine is an addictive chemical. Vaping and nicotine exposure carry health risks, including addiction and risks to the heart, lungs, and developing brain. This site does not tell you that vaping is safe, safer than smoking, or good for you.

The concept is not for minors. It is not for people who are pregnant or breastfeeding. It is not for people with heart or lung conditions, or for anyone a doctor has told to avoid nicotine. It is not a smoking-cessation device, a medical device, or a treatment for any condition. We make no health claims.

Talk to a doctor before using nicotine or any vaping product. Nothing here is a substitute for medical advice.

WARNING: This product concept references nicotine, a chemical known to the State of California to cause birth defects or other reproductive harm. Nicotine is addictive. This notice is a Proposition 65-style warning about the subject of the research concept. Nothing is for sale, and no nicotine product is offered on this site.

This site does not promote THC, cannabis, or any illegal substance. It does not make, sell, or ship nicotine, cannabis, oil, or cartridges. “Any cart” in the concept text means a standard 510 interface in the abstract. It is not an instruction to use a controlled substance.

5. Not medical, legal, or professional advice

The text, pictures, and code on this site are research notes. They are not medical advice, legal advice, engineering advice, safety certification, or any other professional advice. We are not your lawyer, doctor, or safety engineer.

Do not rely on this site to decide whether a device, firmware build, chemical, or business plan is legal, safe, or compliant. Get advice from a qualified professional who knows your situation.

6. Compliance

Laws on nicotine, vaping, batteries, advertising, age limits, shipping, and electronics differ by country, state, and city. Some places ban flavors, online sales, or possession. You are responsible for following the laws that apply to you. We do not promise that viewing this site is lawful where you are.

We do not ship or sell anything. There is no product to import, export, or deliver. If you choose to build hardware yourself, you are the person who must comply with product-safety, battery, consumer, and nicotine rules. We will not do that for you.

United States rules such as FDA tobacco regulation, premarket tobacco product applications (PMTA), and the Prevent All Cigarette Trafficking (PACT) Act can apply to products that are manufactured, marketed, sold, or shipped. No product is marketed, manufactured for sale, sold, or shipped from this site. Those names appear here so it is clear we are not offering a covered product and are not claiming FDA authorization. Nothing on this site is an FDA-authorized tobacco product.

7. Assumption of risk, release, and waiver

Batteries, heating elements, lithium cells, firmware, and homemade electronics can fail. Failures include fire, explosion, burns, chemical exposure, property damage, and serious injury or death. A concept drawing is not a safe design, a tested design, or a design you should build.

If you build, modify, flash, or use any vape, battery, hardware, firmware, or code inspired by this site, you do so entirely at your own risk. You assume every risk of injury, illness, fire, data loss, and property damage, whether or not we warned you about that specific risk.

To the fullest extent the law allows, you release and waive all claims against California Chicken Co. and its directors, officers, employees, contractors, and agents, past and present. The release covers claims arising out of your use of the site, your waitlist submission, and any hardware, firmware, or code you make or use because of the concept. It covers claims for negligence, product liability, and failure to warn, to the extent a release of those claims is allowed where you live. You waive unknown claims as well, including rights under California Civil Code section 1542 and any similar law.

8. No warranties

The site, the concept, the pictures, the text, and any code are provided “as is” and “as available.” We disclaim every warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, non-infringement, and any warranty that comes from a course of dealing.

We do not warrant that the site will be uninterrupted, that the waitlist email will arrive, that the concept is safe or lawful to build, or that any description matches a future device. Research notes can be wrong.

9. Limitation of liability

To the maximum extent permitted by law, California Chicken Co. and its directors, officers, employees, contractors, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or property damage, arising out of the site or the concept. This applies even if we were told those damages were possible, and even if a remedy fails of its essential purpose.

To the maximum extent permitted by law, our total liability for all claims related to the site or these terms is capped at zero US dollars (USD $0). If a law will not allow a cap of zero, the cap is one hundred US dollars (USD $100). That cap is an aggregate cap for all claims, not a cap per incident.

Some places do not allow certain disclaimers or limits. In those places, the limits apply only as far as the law allows. Nothing here limits liability that the law does not let us limit, such as liability for fraud or for willful injury where a statute forbids that limit.

10. Indemnification

You will defend, indemnify, and hold harmless California Chicken Co. and its directors, officers, employees, contractors, and agents from any claim, loss, damage, liability, and expense (including reasonable attorneys’ fees) arising out of your use of the site, your waitlist submission, your breach of these terms, your violation of law, or any hardware, firmware, chemical, or code you build, modify, distribute, or use because of this concept.

We may participate in the defense with our own counsel at our own expense. You will not settle a claim that admits fault by us, or that imposes an obligation on us, without our prior written consent.

11. Waitlist and privacy

The waitlist form asks for an email address, a price you would consider, an optional role, an optional comment, and confirmation that you are 21 or older. A hidden field is used only to catch automated spam. The form sends that information from your browser to Web3Forms, which delivers it to us by email. This site does not keep its own database of signups.

We use that information only to understand interest in the research concept and, if we choose, to send research updates. We do not sell personal information. We do not share it for cross-context behavioral advertising. We do not use it to take orders.

To ask us to delete your email and the answers that came with it, email michael@hellyeahai.com with the subject “Delete my vaping.dev data” and the address you submitted. We will delete what we still have in our inbox and mail system. Web3Forms may keep its own logs under its own policy. We cannot promise to erase copies on systems we do not control.

If you no longer want research emails, use the same address and the subject “Unsubscribe.” We will stop emailing you. That request also counts as a CAN-SPAM unsubscribe. We will honor it within 10 business days.

If the GDPR applies to you, you may ask to access, correct, delete, or restrict the information we hold, and you may object to our use of it. If the CCPA/CPRA applies to you, you may ask to know, delete, and correct personal information, and you may opt out of sale or sharing. We do not sell or share personal information as those laws define those words. To use any of these rights, email michael@hellyeahai.com. We may need to confirm that the request comes from you. You will not be discriminated against for making a request.

The legal bases we rely on, where a law requires one, are your consent when you submit the form and our legitimate interest in reading research feedback. You may withdraw consent by asking us to delete the submission. Withdrawal does not affect processing that already happened.

Do not send sensitive information in the comment field, including government ID numbers, health details, or information about anyone under 21.

12. Third-party services

Web3Forms receives the waitlist form so it can email us. Their handling of that submission is covered by their own terms and privacy policy. We do not control their servers.

Vercel hosts this website. Vercel may process technical data such as IP address and request logs to deliver the site and to keep it secure. That processing is described in Vercel’s own terms and privacy policy.

Anthropic makes Claude and Claude Code, which the concept mentions. This site does not send your waitlist answers to Anthropic. Anthropic does not operate this site and is not responsible for it. If you use Claude or Claude Code, you do so under Anthropic’s terms, not ours.

Links or names of third parties are not endorsements. Their sites can change, and we are not liable for them.

13. Open-source and code, at your own risk

Any code, configuration, firmware sketch, schematic, or prompt on this site or in a related repository is published for discussion. It is not a product, a kit, or a supported release. Building, flashing, or running it is at your own risk, including the risks in the release above.

Unless a file states a different license, we grant no license to make, sell, or distribute a nicotine or cannabis product, and no license to use our name or the vaping.dev name on hardware. Copyright in the site text and original images stays with California Chicken Co. Do not treat the concept as open-source hardware you are cleared to manufacture.

14. Delaware law, arbitration, and class-action waiver

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. The Federal Arbitration Act governs the arbitration agreement in this section.

Except for a claim that seeks only to stop misuse of intellectual property, you and California Chicken Co. agree that any dispute arising out of the site, the concept, or these terms will be resolved by binding individual arbitration, not in court. The arbitration will be seated in Delaware and conducted in English by a single arbitrator. The arbitrator may award only the relief a court could award to one person under these terms, including the liability cap.

You and we each waive a jury trial. You and we each waive the right to bring or join a class action, a class arbitration, a collective action, or a representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If a court finds the class-action waiver unenforceable as to a particular claim, that claim proceeds in court and the rest stay in individual arbitration.

If a court finds that this arbitration agreement is unenforceable in full, the exclusive venue for disputes is the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

If any part of these terms is held invalid, the rest stays in effect. A failure to enforce a term is not a waiver of it.

15. Changes and contact

We may update these terms by posting a new version on this page and changing the “Last updated” date. The new version applies from that date. If you keep using the site after the date changes, you accept the update. If you joined the waitlist and you do not accept an update, email michael@hellyeahai.com and ask us to delete your submission.

Questions about these terms, privacy requests, and underage-data reports go to michael@hellyeahai.com. Mailing a letter is not required. Email is the contact method for this site.

California Chicken Co. is a Delaware corporation. vaping.dev is the name of this research site, not a separate company and not a store.
